Lawyer and Social Activist, Nana Adjoa Adobea Asante, has explained what Akuapem Poloo’s predicament of being allowed out of jail on bail pending appeal actually means.
In an interview with eTV Ghana’s reputable host, Eunice Tornyi on the African Women’s Voices show, she detailed that bail pending appeal means that the convicted actress is now free from prison custody and she can freely move about without any fear of being restricted.
“It means that pending the determination of her matter, which is to request the court to take a second look at her sentencing, she will not be in prison custody. The rationale behind this is to prevent a person who is convicted but has appealed, from serving a full sentence”, she said.
Nana Adjoa shared per her knowledge in law that if a convicted person’s appeal overturns the sentence, then it will be rendered moot if she was not granted bail pending appeal. She added that there are certain conditions that come with being granted bail pending appeal.
Some of these conditions, which of course applied to Akuapem Poloo’s bail pending approval include depositing of the convict’s passport to ensure that she will not travel outside the country. “She will also have to report to the investigator on periodic basis to show that she is still in the country and has not fled or absconded”, the lawyer further explicated.
