Cociane-turned-soda saga; Attorney General and BNI boss to appear before court

The Attorney-General and Minister of Justice and the Director-General of the Bureau of National Investigations (BNI) are to appear before the Human Rights Court next Monday to justify the continued detention of DSP Gifty Mawuenyega.

This follows an ex-parte motion for an order of habeas corpus filed by solicitors of the applicant against the respondents to produce DSP Mawuenyega in court.

DSP Mawuenyega, who is the deputy at the Commercial Crime Unit at the CID Headquarters, is being held on alleged suspicious dealings with Nana Ama Martins, the woman at the centre of the cocaine-turn-sodium carbonate saga.

An affidavit deposed by counsel for the applicant in support of the motion said DSP Mawuenyega was, on December 29, 2011, arrested by officials of the BNI and had been detained till date.

The affidavit said the supposed ground for her arrest and detention was to investigate her involvement in a recent narcotic trial involving one Nana Ama Martins, who had been acquitted and discharged.

According to the affidavit, she had never been brought before a court of competent jurisdiction since her detention.

It said under the 1992 Constitution of Ghana, a person shall not be detained beyond 48 hours without being brought before a court of competent jurisdiction.

“The continued detention of the applicant by the respondent constitutes an infringement of her rights as guaranteed under the Constitution,” the affidavit contended.
